Probate Freaking Sucks

Probate freaking sucks. There’s just no nice way to say it otherwise.

For those who don’t know, probate is the mandatory legal process by which you must go before a judge and validate a will in order to get access to the deceased’s assets after their passing.

And it freaking sucks. It takes thousands of dollars, multiple months (sometimes years), and requires a lot of working with the court and creditors to finish.

This “profound” realization comes after working with a client who just lost their spouse. He was devastated by the loss, and now he cannot access anything left in her name.

He’s in the toughest time in his life, but it’s NOW that the government tells him to figure out major financial decisions and navigate complicated legal proceedings.

It’s messed up.

But there are ways to avoid probate entirely. One is to create a revocable living trust and transfer everything into that trust while the client is still alive. Another is to change beneficiary designations on important assets and accounts to go directly to beneficiaries. Lastly, purchasing important financial products like life insurance and annuities can set aside money that otherwise would have gone through probate.

But, at the end of the day, you want to make sure you get it right the first time: there’s no correcting mistakes after someone has passed away.

It’s a high pressure situation, but, if done right, you and your loved ones can completely avoid probate do what you’re supposed to do when someone passes: grieve and remember their legacy.
